| Ruling Text: Mr. Miller was the trainer of record for VESPA N in the 9th Race at Yonkers Raceway on April 27, 2023. Post race analysis of sample 3534413 contained ALTRENOGEST. VESPA N finished 1st, was disqualified and placed 7th. Having appeared before a representative of the NYSGC and having had formal hearing, and right to appeal, Mr. Miller's 30 day suspension and $2,000 fine is hereby reduced to a $1,000 fine and a 15 day full suspension to be served February 6,2024 through and including February 20,2024. During the term of suspension, Mr. Miller is ruled off all grounds under the jurisdiction of the NYSGC and deemed a disqualified person and is not permitted to participate in any racing activities. Mr. Miller is ordered to return all purse monies earned from the above mentioned race. VESPA N shall be required to provide a negative sample prior to being permitted to enter to qualify or race. (negative sample has been provided). No trainer transfers of horses under Mr. Miller's care will be permitted during the term of suspension. |
