| Ruling Text: Mr. John Cummings, as the driver of #2 SANTANA BEACH on December 9th in the 4th race at Batavia Downs ,did pull to the outside in the stretch without sufficient clearance and interfered with #6 BARRY HANOVER. Mr. Cummings finished 2rd and was disqualified and placed 3rd. Having reviewed Mr. Cummings previous penalties, (2nd Offence in this category in 365) and having waived your right to appeal, your suspension has been reduced from eight days to five days. Further violations of this nature will result in greater penalties. This is a DRIVING suspension only.
