FINDINGS & ORDER
BL 9-2023
The New York State Gaming Commission (“Commission”) conducted a hearing, as requested by Jaime A. Torres (“Respondent”), after Respondent received notice of the Commission’s suspension of Respondent’s occupational license for 14 calendar days pursuant to 9 NYCRR §§ 4035.2, 4022.11 and 4022.12 for engaging in careless riding.
Respondent received proper notice of, and participated in, a hearing conducted by video conference on July 28, 2023, August 25, 2023 and September 22, 2023. The hearing was conducted on the grounds set forth in the Notice of Hearing dated July 13, 2023.
The Hearing Officer submitted a Findings of Fact, Conclusions of Law, and Recommended Decision dated February 12, 2024 (the “Report”) to the Commission for deliberation, a copy of which is attached hereto and incorporated herein.
The Commission met on March 25, 2024, and after consideration and due deliberation of the entire record, adopted the Hearing Officer’s findings of facts and conclusions of law in the Report.
THEREFORE, based upon the entire record (including, without limitation, the evidence specifically relied upon by the Hearing Officer), the Report, and the findings and conclusions adopted by the Commission, it is hereby
ORDERED, that Respondent’s Commission-issued license (# 1578932-2024) is suspended for 14 calendar days, to be assigned by the State Steward, during which time Respondent shall not participate in New York pari-mutuel racing.
