| Ruling Text: Mr. Nappo was the trainer of record for RUTHMAE HANOVER in the 5th Race at Buffalo Raceway on April 5th, 2023. Post race analysis of sample CV3543235 contained Atenolol. Ruthmae Hanover Finished 2nd , is disqualified and placed 8th.Also Mr Nappo was trainer of record for Daylon Phantom in the 1st race at Buffalo Raceway on April 14,2023 Post race analysis of sample CV3543998 contained ATENOLOL Daylon Phantom Finished 2nd , is disqualified and placed 7th.Also Mr Nappo was Trainer of record for DAYLON PHANTOM in the 5th race at Buffalo raceway on april 28,2023 post race analysis of sample 2203309 contained ATENOLOL. Daylon Phantom Finished 2nd,is Disqualified and placed 8th. Having appeared before a representative of the NYSGC and waiving his right to a split sample, formal hearing, and right to appeal, Mr. Nappo`s $2000 fine and 30 day suspension is hereby reduced to a $1000 fine and a 15 day full suspension of his license to be served June 01, 2023 through and including June 15, 2023. During the term of suspension, Mr. Nappo is ruled off all grounds under the jurisdiction of the NYSGC, is deemed a disqualified person, and is not permitted to engage in any racing activities. Mr Nappo is ordered to return all purse monies earned in the above mentioned races.(Purse monies have been returned). Ruthmae Hanover and Daylon Phantyom shall be required to submit a negative sample prior to being permitted to enter to race or qualify (negative samples have been provided). Any and all trainer transfers of horses under Mr Nappo care must be approved by the Presiding Judge at Buffalo Raceway. |
