FINDINGS & ORDER
AQ 20-2023
The New York State Gaming Commission (“Commission”) conducted a hearing, as requested by Thomas S. LaMarca Jr. (“Respondent”), after Respondent received notice that the Commission fined Respondent $2,000 for transferring a claimed horse, Irish Honor, within 30 days from the date of the claim, in violation of 9 NYCRR § 4038.4.
Respondent received proper notice and appeared at a hearing, conducted by video conference on October 12, 2023. The hearing was conducted on the grounds set forth in the Notice of Hearing dated September 14, 2023.
The Hearing Officer submitted a Hearing Officer Report and Recommendations, a copy of which is attached hereto and incorporated herein.
The Commission met on January 29, 2024, and, after consideration and due deliberation of the entire record, adopted the Hearing Officer’s findings of facts and conclusions of law in the Report.
THEREFORE, based upon the entire record (including, without limitation, the evidence specifically relied upon by the Hearing Officer), the Report, and the findings and conclusions adopted by the Commission, it is hereby
ORDERED, that the charge of violating 9 NYCRR § 4038.4 against Respondent and the resulting penalty of $2,000 be dismissed.
