Ruling Text: Trainer Mr. Norman Follett is hereby fined the sum of two thousand ($2,000) dollars for violating rule #4038.4, Sale Transfer restricted. This for the transfering of a claimed horse prior to the 30 days from the date of the claim. Having appealed a stay has been granted.

FINDINGS & ORDER
AQ 18-2023
The New York State Gaming Commission (“Commission”) conducted a joint hearing, consolidating the hearing requests of trainer Norman C. Follett (“Respondent Follett”) and owner Alexander Kazdan (“Respondent Kazdan”) (each a “Respondent” and, collectively, “Respondents”), after each of the Respondents received a notice that the Commission fined such Respondent $2,000 for transferring a claimed horse, Microscope, within 30 days from the date of the claim, in violation of 9 NYCRR § 4038.4.
Each Respondent received proper notice and appeared at a hearing, conducted by video conference on July 26, 2023 and September 28, 2023. The hearing was conducted on the grounds set forth in the Notice of Joint Hearing dated June 28, 2023.
The Hearing Officer submitted a Hearing Officer Report and Recommendations (the “Report”), a copy of which is attached hereto and incorporated herein.
The Commission met on January 29, 2024, and, after consideration and due deliberation of the entire record, adopted the Hearing Officer’s findings of facts and conclusions of law in the Report.
THEREFORE, based upon the entire record (including, without limitation, the evidence specifically relied upon by the Hearing Officer), the Report, and the findings and conclusions adopted by the Commission, it is hereby
ORDERED, that the charge of violating 9 NYCRR § 4038.4 against Respondent Follet and the resulting fine of $2,000 be dismissed; and
ORDERED, that the charge of violating 9 NYCRR § 4038.4 against Respondent Kazdan and the resulting fine of $2,000 be dismissed.
