| Ruling Text: On Monday, January 23, 2023, while driving the 2 horse, Pogey Beach, in the 13th race at Batavia Downs, you did cause the 9 horse, Yankee On The Move, to cross over the limits of the race course by driving in a reckless manner after the start of the race. Due to the infraction, your horse, Pogey Beach, was disqualified from 3rd and placed 9th. For this infraction, you are hereby suspended 8 days from February 17, 2023 until February 24, 2023. However, after appearing before a representative of the NYS Gaming Commission and waived your right to appeal, your penalty has been reduced to 5 days from February 17, 2023 until February 21, 2023. |
