| Ruling Text: As trainer of record for horse #4 (The Mexican), which finished 2nd in the 8th race at Batavia Downs on Wednesday, October 23rd, 2019, and whose post race sample contained Methylprednisolone at a concentration in excess of 100pg/ml (including an assessment of the measurement of uncertainty and imprecision of the quantitative threshold), as determined by the laboratory conducting tests for the Commission, in violation of 9 NYCRR 4043.3(a)(17); and the horse having been administered methylprednisolone, was raced before testing below such threshold and being released to race by the presiding judge in violation of 9 NYCRR 4120.2(m). The horse was disqualified from its 2nd place finish and placed 8th. All purse money earned in that race by your horse must be returned for redistribution and the horse must produce clean samples before it can race.
Having appeared before a representative of the NYS Gaming Commission and waived your right to appeal, and the Commission considering the circumstances, your suspension has been reduced from 15 days to seven days, and your fine has been reduced from $1,000 to $500. Your suspension begins on Sunday, December 8th and ends on December 14th, 2019. You are eligible to participate on December 15th, 2019. |
