Having received a hearing before the NYS Gaming Commission concerning the Stewards decision on the 7th race on June 28th, 2019, and the commission having upheld the Stewards ruling, Jockey Luis Saez is suspended for 7 NYRA racing days effective June 4th, 2020, through June 13th, 2020 , inclusive.

FINDINGS AND ORDER
The New York State Gaming Commission ("Commission") conducted a hearing in this matter pursuant to Section 220(2) of the Racing, Pari-Mutuel Wagering and Breeding Law (Racing Law), Article 3 of the State Administrative Procedure Act and Part 4550 of the Commission's rules at 9 NYCRR at the request of jockey Luis Saez ("Respondent") after the Commission Steward at Belmont Park suspended him for seven New York Racing Association, Inc. (“NYRA”) racing days for careless riding in the 7th race at Belmont Park on June 28, 2019, in violation of 9 NYCRR § 4035.2(d).
Respondent received proper notice and participated with the assistance of counsel in a hearing conducted on August 29, 2019. The Hearing Officer rendered his report on October 10, 2019, which is attached and incorporated herein.
The Commission met on October 28, 2019, and after due deliberation adopted the Hearing Officer's findings of fact and conclusions of law.
THEREFORE, upon the record, the report of the Hearing Officer and the findings and conclusions adopted by the Commission, it is hereby,
ORDERED, that Respondent's violation and suspension for seven racing days are affirmed, and
ORDERED, that Respondent shall serve his suspension for a period of seven NYRA racing days while racing is being conducted at Belmont Park. |
