| Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE COMMISSION REFUSES TO ISSUE YOU A LICENSE TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 01/25/2018, RECEIPT# 1447040, FOR THE FOLLOWING REASONS:
YOUR EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT YOUR PARTICIPATION IN RACING OR RELATED ACTIVITIES WOULD BE INCONSISTENT WITH THE PUBLIC INTEREST,CONVENIENCE OR NECESSITY, OR WITH THE BEST INTERESTS OF RACING GENERALLY.
IN ADDITION THE PERMANENT REVOCATION OF ALL YOUR RACING LICENSES BY THE NJRC IS RECOGNIZED AND ENFORCED AS A REASON TO DENY YOUR APPLICATION FOR A LICENSE TO RACE IN NEW YORK PURSUANT TO RACING AND PARI-MUTUAL WAGERING AND BREEDING LAW 910.

Findings and Order -
Carl F. Conte, Jr. (“respondent”) requested a hearing in the matter of the New York State Gaming Commission (“Commission”) denial of his application for a harness trainer-driver license based upon his character and fitness and the recognition and enforcement of the permanent revocation of his racing licenses by another racing commission, pursuant to Racing, Pari-Mutuel Wagering and Breeding Law §§ 309 and 910 and 9 NYCRR 4101.24. Respondent received proper notice and participated in a hearing conducted on September 28, 2018. The Hearing Officer rendered her report on January 12, 2019, which is attached and incorporated herein.
The Commission met on March 25, 2019, and after due deliberation adopted the Hearing Officer’s findings of fact and conclusions of law.
THEREFORE, upon the record, the report of the Hearing Officer and the findings and conclusions adopted by the Commission, it is hereby,
ORDERED, that the Commission affirms the denial of respondent’s license by the Commission. |
