Mr. Carlos Figueroa Jr. is hereby suspended 60 days for Violation  NYCRR 4038.1(a) Who may make a claim and 4038.11(a) Collusive claiming punished. Mr. Figueroa having waived his right of appeal 15 days are stayed for a period 1 year from the date of this ruling pending no further violation of Commission rules 4038.1(a) and 4038.11

 

Mr. Carlos Figueroa Jr. committed an improper, corrupt and fraud act in relation to racing.

 

1) Mr. Carlos Figueroa Jr. claimed horse Banner Bill in the 4th race at Aqueduct Racetrack on April 22, 2017 knowing that Banner Bill was to be transferred to a different ownership  In violation of 9 NYCRR 4038.11(A)

 

2) Mr. Figueroa Jr. entered and ran horse Banner Bill in the 7th race at Belmont Park on May 10, 2017 knowingly that any proceeds from the race were not going to the listed owner Heart of Success Racing Stables Violation of 9 NYCRR 4002.9(a) 4042.1(f).

 

Ordered that during your period of suspension, you shall not directly or indirectly participate in New York State pari-mutuel horse racing. You are denied the privileges and use of the grounds for all racetracks, you are forbidden to participate in any share of purses or other payment. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, that (a) is owned or trained by you, or by any individuals who serves as you agent or employee during your suspension; or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ or insure workers, provide advise or other information or otherwise assist with any aspect of the training of such horse.
