Gaming Commission

As per Stipulation Mo 273-2014-On March 10,2013,the horse,Majestic Marquet trained by Rodolfo(Rudy) Rodriguez competed in the 8th race at Aqueduct Racetrack and finished first while the drug flunixin,which had been administered within 24 hours of the scheduled post time of the race by intravenous injection,or by any means within 48 hours of the scheduled post time of the race,was present in its system in violation of Rules 4043.2(d)(1),4043.2(e)(14),4043.4 .The horse Majestic Marquet is hereby disqualified from any share of the purse money and unplaced in the order of finish.

 

On April 26,2013,the horse,Vee's Accolade,trained by Rodolfo(Rudy) Rodriguez,competed in the 6th race at Belmont Park and finished second while the drug,fuunixin,which had been administered within 24 hours of the scheduled post time of the race by intravenous injection,or by any means within 48 hours of the scheduled post time of the race was present in its system,in violayion of Rules 4043.2(d)(1),4043.2(e)(14),4043.4.The horse Vee's Accolade is hereby disqualified from any share of the purse money and unplaced in the order of finish

You are hereby suspended 25 days and fined the sum of $2,500.00

 

Ordered that during your period of suspension,you shall not directly or indirectly participate in New York State pari-mutuel horse racing.You are denied the privileges and use of the grounds for all racetracks,you are forbidden to participate in any share of purses or other payment.Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New YorkState,that (a) is owned or trained by you,or by any individuals who serve as your agent or employee during your suspension;or (b)for which you during your suspension are directly or indirectly with training,including any arrangements to care for,train,enter,race,invoice,collect fees or other payments,manage funds,employ or insure workers,provide advise or otherwise assist with any aspect of the training of such horse.

 

The Stipulation in settlement of AQ 62-2012,is here by amended as follows;Paragraph 4 of the Stipulation of AQ 62-2012 is deleted and replaced by the following:

Roldolfo (Rudy)Rodriguez agrees that in the event that any horse trained by him has an equine drug positive in the state of New York for a Probationary Period from the date of Rodolfo(Rudy)Rodriguez executes the Stipulation in settlement of MO 273-2014 until nine months from the day of the completion of the 25-day suspension for the violations set forth in MO 273-2014,Rodolfo(Rudy)Rodriguez shall serve the 20 days that had been suspended,as described in paragraph 3 of this Stipulation,in addition to any penalty that may result from such additional equine drug positive.Rodolfo (Rudy)Rodriguez accepts and agrees that he waives any and all right to appeal or challenge in any court,tribunal or other forum any matter in connection with the equine drug positives that are subject of this Stipulation including without limitation the imposition of the additional 20-day  suspension as set forth in this Stipulation.Rodolfo (Rudy)Rodriguez

shall serve such additional 20 days as directed by the Gaming Commission after the notice of violation for an equine drug positive violation within the Probationary Period is issued,or after final Gaming Commission agency adjudication of such equine drug positive violation within the Probationary Period,whichever is later."
