As trainer of record of "Irish Bride" and "Black Diamond Girl" that raced at Tioga Downs, the Commission determines that you committed two acts not in the best intrest of racing and that are injurious to the character of the turf. Prior to the races of "Irish Bride" on 07/25/2014 and "Black Diamond Girl" on 07/11/2014, you unwittingly caused each horse to be administered an unusual and excessive dose of the prescription drug phenytoin. This resulted from your failure to be aware of the potency of the drug formulation that you obtained and used and an absence by a treating veterinarian of a physical eximination, diagnosis, treatment, and subsequent evaluation of the horse and this drug regimen. This action constituted poor care of the horse and created an unaccaptable potential to affect its race performance. You did attest to the fact that you gave the supplement PHENYTOIN SODIUM to these horses, that you did not know the actual potency of this drug when you used it, that the potency was far greater than you thought and that this excessive dose was not necessary or appropriate for treating the horses. The Commission has determined that you are responsible for the usage of any prescription drug supplements that you may have given your horses, and you are the responsible party for the outcome of such an act. Therefore, you are hereby fined the sum of $1,000.00. Having signed the waiver, your fine has been reduced to $500.00.
