As trainer of record of Heavenly Bride that raced at Yonkers Raceway the commission determines that you committed two acts not in the interest of racing and that are injurious to the character of the turf.     

 

Prior to the race of Heavenly Bride on 7/22/14 you unwittingly caused the horse to be administered an unusal and excessive dose of the prescription drug phenytoin sodium (e.g., Dilantin).  This resulted from your failure to be aware of the potency of the drug formulation that you obtained and used and an absence by a treating veterinarian of a physical examination, diagnosis, treatment, and subsequent evaluation of the horse and this drug regimen.  This action constituted poor care of the horse and created an unacceptable potential to affect its race performance.

 

You did attest to the fact that you gave the supplement PHENYTOIN SODIUM to the horse, that you did not know the actual potency of this drug when you used it, that the potency was greater than you thought, and that this excessive dose was not necessary or appropriate for treating the horse.

 

The COMMISSION has determined that you are responsible for the usage of any prescription drug supplements that you may have given your horse, and you are the responsible party for the outcome of such an act.  Therefore, you are hereby fined the sum of $1,000 reduced to $500.
