As per Stipulation of Settlement MO 70-2014 you are hereby suspended 45 days and fined 10,000 dollars because horse "Wind Of Bosphorus" competed in the 2nd race at Belmont Park on June 2, 2013 with a benzodiazepine drug, containing and/or capable of metabolizing into oxazepam, having been administered within one week of the scheduled post time of its race in violation of 9 NYCRR 4043.2(h). You were the trainer of record, as term is defined in 9 NYCRR 4043.4 for Wind of Bosphorus" at the time of the race in question. You are responsible for the violation of 9 NYCRR 4043.2(h) described herein, as trainer of "Wind of Bosphorus," pursuant to the New York trainer responsibility rule, 9 NYCRR 4043.4 Horse "Winds of Bosphorus" is hereby disqualified from any share of the purse money and is unplaced in the order of finish of said race. You shall serve a further suspension of 45 days in the event that any horse trained by you has an ARCI penalty guidelines class I, II, or III equine drug positive in a pari-mutuel jurisdiction on or before December 18, 2015. The New York State Gaming Commission agrees that if no horse trained by you has an equine drug positive in a pari-mutuel jurisdiction on or before December 18, 2015, then the potential additional 45-day suspension shall be discharged.
Ordered that during your period of suspension, you shall not directly or indirectly participate in New York State pari-mutuel horse racing. You are denied the privileges and use of the grounds for all racetracks, you are forbidden to participate in any share of purses or other payment. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, that (a) is owned or trained by you, or by any individuals who serves as you agent or employee during your suspension; or (b) for which you during your suspension are directly or indirectly with training, including any arrangements to care for, train, enter, race, invoice, collect fees or other payments, manage funds, employ or insure workers, provide advise or other information or otherwise assist with any aspect of the training of such horse.
