| Ruling Text: Jockey Michael A. Davila, Jr., rider of “Lightning Lu” (#4), is suspended for 7 calendar days effective Friday, July 26, 2013 through Thursday, August 1, 2013, inclusive; for interfering with “Mad River” (#6) in the area of the 3/8ths pole during the running of the 5th race on July 18, 2013.
Having appealed, a stay is granted for 90 days for Jockey M. Davila, Jr. to complete his appeal hearing and, should he do so within 90 days of this ruling, for such time as the commission takes to decide his appeal. If he fails to complete the evidentiary hearing within 90 days of this ruling, however, then this stay will expire and his penalty will begin. M. Davila, Jr. may seek an additional stay for good cause shown by filing a motion for another stay with the Secretary of the Gaming Commission.
