The New York State Gaming Commission (“Commission”) has found that you, Craig E. Sweeting, engaged in improper acts and practices in relation to racing by neglecting to provide necessary sustenance and care to several horses that were in your custody, care, and control at your thoroughbred racehorse training and boarding farm at 1733 Calkins Road, Pittsford, New York. These horses were “Nitty’s Gold” and three other young horses, during the winter of 2011-12, and the horse “Fresh Footnotes,” from April to August 2012. This conduct violated Section 353 of the Agriculture and Markets Law, which relates to racing, section 220(2) of the Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law”), and subdivision 4042.1(f) of Title 9 of the New York Code of Rules and Regulations.
Pursuant to sections 220(2) and 250 of the Racing Law, your penalty for these violations, in total, is a fine of $3,000; provided, however, that the collection of $2,000 of such total fine shall be stayed and thereafter discharged in the event that you complete a period of time through December 31, 2014, during which you do not engage in any further acts or omissions leading to horse cruelty or abuse.
You are hereby directed to pay $1,000 of your fine on or before June 13, 2013. You shall be ineligible to participate in racing after that date unless and until this portion of your fine is paid, and a failure to pay said amount by this date will result in the assessment of interest and/or a late payment charge and may result in other collection charges and/or further discipline.
