Ruling Text: PLEASE TAKE NOTICE that your license to participate in thoroughbred racing in New York State as a groom is hereby SUSPENDED IMMEDIATELY pending the disposition by the New York State Racing and Wagering Board (Board) of the scheduled hearing before the Board or, if you refuse such hearing or default in appearing, SUSPENDED until such time as the Board in its discretion takes further action, including but not limited to license suspension or revocation or refusal to license. This action is taken pursuant to Racing, Pari-Mutuel Wagering and Breeding Law § 220 Sub 2, 9(E) NYCRR §§ 4042.5 (a) and (c); and/or State Administrative Procedure Act § 401(3), upon a finding of the Board that the public safety and welfare imperatively require this emergency action due to the nature of the violation and the need to assure the integrity of the racing conducted, as well as the safety of the participants and to protect the public safety and welfare, based upon the circumstances and charges stated more particularly as follows: On June 6, 2012 you submitted a positive human drug test for Cocaine, and on February 17, 2012 you submitted a positive human drug test for Synthetic Cannabinoid metabolite, both while on the grounds of Belmont Park, in violation of 9(E) NYCRR §§ 4042.5 (a) and (c).The above conduct constituted a violation of the voluntary conditions which you signed to induce the Board to reinstate your license on July 22, 2011 following a voluntary surrender of your license which you had signed on May 4, 2011.The conditions that you signed required you to conduct yourself in a manner consistent with the behavior of a licensee of the Racing and Wagering Board; that you not use any illegal drugs or medications and that you not engage in the abuse of alcohol, and that failure to comply may result in suspension or revocation of any NYSRWB issued license.
