Having received a report from the New York State Racing and Wagering Board Equine Drug Testing Laboratory of the finding of Carboxycelecoxib, a metabolite of Celecoxib (Celebrex) in the body fluid samples taken from the #8 horse "Missed the Notes", which finished 1st in the 9th race on October 25, 2011, and been afforded ample time to receive an independent referee test, Trainer Rafael Rohena Sr. is suspended for 60 racing days effective Friday June 29, 2012 through Monday August 27, 2012 inclusive and hereby fined the sum of $2, 500. This being the second such positive in less than six (6) months, this case is referred to the New York State Racing and Wagering Board for additional action which the Board may deem appropriate. Ordered that during your suspension, Trainer Rafael Rohena Sr. shall not directly or indirectly participate in New York State pari-mutuel racing, and is denied the privileges and use of the grounds of all race tracks. Trainer Rafael Rohena Sr. is forbidden to participate in any share of purses or other payments. Every horse is denied privileges of the grounds and shall not participate in pari-mutuel in New York, further that is (a) owned or trained by you, or any individual who serves as your agent or employee during your suspension; or (b) for which you during your suspension are involved directly or indirectly with training including any arrangements made to care for, train, enter, race, invoice, collect fees, or payments, manage funds, employ or insure workers, provide advise or information, or otherwise assist with any aspect of the training of the horse.  The Stewards order the redistribution of the purse as follows:  1st- #7 Tokens Only, 2nd-#9 Three Dreams, 3rd-#5 Pretty Victory, 4th-#4 Columbia Falls, 5th-#10 Irish Miss, 6th-#3 Taconic Girl, 7th-#1 Madeline's Melody, 8th-#2 Silver Minted, 9th-#6 Golden Ladder  This fine and suspension is stayed pending the outcome of Trainer Rafael Rohena's appeal filed today, Monday June 25, 2012.
 
Assistant Trainer Rafael G. Rohena, Sr., having made a settlement with the NYS Gaming Commission concerning his appeal, is suspended for 45 calendar days effective Monday, July 14, 2014 through August 27, 2014, inclusive, and fined $1,250; for the finding of Celecoxib (Celebrex) in the body fluid sample taken from horse “Missed the Notes,” which finished 1st in the ninth race on October 25, 2011, a second post race positive violation for this drug.
 
In a previous ruling “Missed the Notes” was disqualified from any part of the purse and the purse was redistributed.
 
During his period of suspension, Assistant Trainer Rafael G. Rohena, Sr. shall not directly or indirectly participate in New York State pari-mutuel horse racing and is denied privileges and use of the grounds of New York State race tracks and he shall be forbidden to participate in any share of purses.
