Ruling Text: Having shown the existence of special circumstances and having withdrawn your appeal, your suspension is hereby increased to 20 calendar days commencing July 20, 2012 and ending on August 8, 2012 and your fine is hereby rescinded. This for the finding of the drug Flunixin in the post race samples of horse Leap Day who finished 4th in the 10th race at Aqueduct Racetrack on February 18, 2012. This drug was administered in violation of New York State Racing and Wagering Board rule 4043.2 and 4043.4. Said horse is hereby disqualified and unplaced in the order of finish. Ordered that during your suspension, you shall not directly or indirectly participate in New York State pari-mutuel racing, you are denied the privileges and use of the grounds for all racetracks, you are forbidden to participate in any share of the purses or other payments. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel in New York, further that is (a) owned or trained by you , or any individual who serves as your agent or employee during your suspension; or (b) for which you during your suspension are involved directly or indirectly with training, including any arrangements made to care for, train, enter, race, invoice, collect fees or payments, manage funds, employ workers, provide advise or information, or otherwise assist with any aspect of the training of the horse.
