| Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at 1 Broadway Center, Suite 600, Schenectady, New York, 12305, 11:00 A.M., Tuesday, February 21, 2012, why your license to participate as an owner in pari-mutuel harness racing should not be suspended or revoked pursuant to §§ 309, and 321 of the Racing, Pari-Mutuel Wagering and Breeding Law and the Rules and Regulations of the New York State Racing and Wagering Board, 9E NYCRR §§4119.1, 4119.7(b), 4119.8 and 4119.9(a) because: 1. You have been indicted by a Grand Jury in Albany County for the crimes of Criminal Sale of Marijuana, in violation of Penal Law §221.55, a Class C-1 Felony, and Penal Law §221.25, a Class D-2 Felony. 2. Your experience, character and general fitness are such that participation in racing by you would be inconsistent with the public interest, convenience or necessity, or in the best interest of racing generally. FINDING AND ORDER, KRISTEN M. BUCKLEY, MAY 30, 2012: having received proper notice and having failed to appear at a hearing conducted on February 21, 2012, and the Hearing Officer having rendered his report on May 8, 2012, which is attached hereto and incorporated herein, THE BOARD, after due deliberation, having met on May 30, 2012 and adopted the Hearing Officer’s findings of fact and conclusions of law, THEREFORE, upon the record, the Report of the Hearing Officer, and the findings and conclusions adopted herein, it is hereby ORDERED, that the license of Respondent, Justin B. Meagher is suspended pending disposition of the criminal matter and is deemed revoked if he is convicted of any of the criminal charges, and he is denied the privileges of the grounds of all racetracks under the jurisdiction of this Board. |
