 Respondent, Jerome R. Palumbo, was required  by Order to Show Cause date January 18, 2012 and amended March 15, 2012, to demonstrate why his license to participate as a groom, stable employee or otherwise in pari-mutuel thoroughbred racing should not be revoked, a fine imposed and why he should not be barred from participating in racing in New York State in any capacity pursuant to Section 220, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law and the Rules and Regulations of the New York State Gaming Commission, 9 NYCRR §§ 4002.8, 4002.9(a) and (c) 4002.10, and 4002.19; and by Amended Order to Show Cause (Amended-2) by the New York State Gaming Commission, dated September 3, 2015, because his experience, character and general fitness are such that his  participation in racing by you would be inconsistent with the public interest convenience or necessity, or in the best interest of racing generally for violating the rules of racing set forth in 9 NYCRR §§ 4002.1, 4002.2, 4002.8, 4002.19, 4042.1(f), 4042.4(b), 4043.2, 4043.8 and 4043.4 [see also 9 NYCRR §§ 4003.46, 4042.4 (a) and 4042.4 (b)]; and
   This matter having been heard on June 12, 2012 before Hearing Officer Clemente Parente, and the Respondent having appeared with counsel and having testified, and Mr. Parente having resigned without rendering a report, and the Respondent having received proper notice and having agreed that  a new Hearing Officer could report to the Commission based upon the record, including the transcript, and exhibits in evidence from the June 12, 2012 hearing; and the Hearing Officer having rendered his amended report on March 8, 2016, which is attached hereto and incorporated herein; and
  THE COMMISSION, after due deliberation, having met on April 25, 2016 and having adopted the Hearing Officer’s findings of facts and conclusions of law, except the Commission having found that the penalty recommended by the Hearing Officer is inadequate in view of the nature and extent of the Respondent’s conduct, has increased the length of the Respondent’s exclusion and has increased his fine; and
  THEREFORE, upon the record, the Report of the Hearing Officer and the findings and conclusions modified herein; it is hereby,
  ORDERED, that the occupational license of Respondent, Jerome Palumbo, as a groom is revoked and he is ineligible to apply for any racing license for a period of five (5) years and is excluded from all New York racetracks as a licensee, participant, or patron for a period of five (5) years and fined $10,000, pursuant to New York State Racing, Pari-Mutuel Wagering and Breeding Law §§ 220(2) and 250.
