| Ruling Text: YOU ARE HEREBY ORDERED to SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at 1 Broadway Center, Suite 600, Schenectady, New York, 12305 at 10:00 A.M., Thursday, September 29, 2011, pursuant to Section 309, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law"), and the Rules and Regulations of the New York State Racing and Wagering Board, 9 NYCRR Parts 4102.1 and 4119.11: Why your license to participate in pari-mutuel harness racing as a trainer should not be denied, suspended or revoked, and/or a fine imposed pursuant to 9 NYCRR §4102.3(a)(1)-(4) for violation of the conditions of a voluntary agreement that you signed June 21, 2011, a copy of which is attached. The agreement requires you to participate in the NYSRWB’s Drug/Alcohol Abuse Program. More than 15 days have elapsed since you signed the agreement for conditions, but a report from a certified alcohol and drug treatment program has not been provided, in violation of your conditions and 9 NYCRR §4119.11(c). FINDINGS AND ORDER, Kristen M. Buckley, March 1, 2012: ORDERED, that the Harness Racing Trainer license of Respondent, Shawn Barker, be and hereby is revoked. |
