| Ruling Text: MATEO MELGAR, YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board, at its office located at One Broadway Center, Sixth Floor, Schenectady, New York, on Wednesday, August 24, 2011 at 11 a.m., why, pursuant to Racing, Pari-Mutuel Wagering and Breeding Law section 213(2) and 9 NYCRR section 4002.9(a) why your license to participate in pari-mutuel thoroughbred racing as an Exercise Rider should not be suspended and/or revoked because : 1. You presented fraudulent Social Security information on your New York State Racing License Application, in violation of Section 213(2) of the Racing, Pari-Mutuel Wagering and Breeding Law, and Section 4042.1(f) of 9 New York Code Rules and Regulations ; 2. Your aforementioned acts and omissions display fraud or misrepresentation in connection with racing, reflecting on your experience, character and general fitness, inconsistent with public interest, convenience or necessity and with the best interests of racing generally. FINDINGS AND ORDER, APRIL 3, 2012, Kristen M. Buckley; ORDERED, that the license of Mr. Melgar is hereby suspended until such time as a judgment has been rendered in connection with the Federal Court indictment filed in the U.S. District Court Northern District of New York; and it is further ORDERED, Mr. Melgar’s occupational license in pari-mutuel thoroughbred racing shall be revoked in the event that Mr. Melgar is convicted of either of the New York DWI charges or either count contained in the U.S. District Court indictment, including a plea of guilty to a lesser offense to resolve the Federal Court Indictment. |
