| Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU A LICENSE TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 4/9/2011, RECEIPT# SR 1321384, FOR THE FOLLOWING REASON: YOUR EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT YOUR PARTICIPATION IN RACING OR RELATED ACTIVITIES WOULD BE INCONSISTENT WITH THE PUBLIC INTEREST,CONVENIENCE OR NECESSITY, OR WITH THE BEST INTERESTS OF RACING GENERALLY. FINDINGS AND ORDER, JANUARY 27, 2012, Kristen M. Buckley: ORDERED, that the Division of Licensing denial for a license as an owner/trainer/driver in harness racing be, and is hereby affirmed; and that Mr. McQueen is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under the jurisdiction of this Board; and IT IS FURTHER ORDERED, if there is no further derogatory information disclosed regarding McQueen, that any new license application submitted by McQueen be acted on favorably so long as such an application is submitted at least six months after successful completion of his probation and no further negative or derogatory information be received by the Board. |
