Ruling Text: ORDERED TO SHOW CAUSE WHY YOUR LICENSE SHOULD NOT BE SUSPENDED OR REVOKED. FINDINGS AND ORDER, March 11, 2008, Gail Pronti: ORDERED, that the license of the Respondent to participate in pari-mutuel harness racing in the State of New York is suspended for a period of 90 days. DECISION AND ORDER, April 28, 2008, Gail Pronti: ORDERED that the Application for Reconsideration is denied. IN THE MATTER OF ALESSANDRO SPANO – REQUEST FOR RECONSIDERATION 4/28/08-The New York State Racing and Wagering Board denied Mr. Spano’s request that the Board grant reconsideration of its March 7, 2008 determination. ORDER OF SUSPENSION, Kristen M. Buckley, April 13, 2011: Upon the Findings and Order of the Board dated January 26, 2009 which suspended the occupational license of Alessandro Spano for 90 days because, pursuant to 9 (E) NYCRR §4102.3(a)(1)-(4) for violation of 9 (E) NYCRR §4120.6(a) and (c) in that on September 8, 2006 he did have or possess in or upon the premises of a licensed harness race track and did have or possess in his personal property or effects upon such premises equipment which may be used for hypodermic injection into a horse or any vial, bottle, or cartridge designed and useable for such purpose; said hypodermic syringes contained carbazachrome salicylate, otherwise known as “Kentucky Red”, a drug which has not been approved for use in a horse by the Federal Food and Drug Administration and did not bear labels stating plainly the contents thereof including the name of each active ingredient as required by 9 (E) NYCRR §4120.6(c); and Said Findings and Order having been confirmed by the New York Supreme Court, Appellate Division – First Department in an opinion entered April 1, 2010, and the New York State Court of Appeals having denied leave to appeal by Order entered April 5, 2011, and said suspension having been stayed and not previously implemented; it is hereby ORDERED, that Respondent, Alessandro Spano’s license suspension for a period of 90 days shall take effect April 14, 2011 and he is declared ineligible to participate in New York until July 14, 2011; and it is hereby further ORDERED that during the period of his suspension, Respondent, Alessandro Spano shall not directly or indirectly participate in New York pari-mutuel harness racing, he is denied the privileges and use of the grounds of all racetrack under the jurisdiction of this Board, and is forbidden to participate in any share of purses or other payment.
