| Ruling Text: PLEASE TAKE NOTICE that your occupational license to participate in pari-mutuel thoroughbred racing as a GROOM and EXERCISE RIDER is hereby SUSPENDED IMMEDIATELY pending the disposition by the Board of the scheduled hearing before the New York State Racing and Wagering Board or, if you refuse such hearing or default in appearing, SUSPENDED until such time as the Board in its discretion takes further action, including but not limited to license suspension or revocation or refusal to license. FINDING AND ORDER, JANUARY 28, 2011, Gail Pronti: ORDERED, that the May 17, 2010 summary suspension be and is hereby upheld, and further ORDERED that, as a result of the violation of the “Consent to Conditions for Reinstatement” agreement dated December 12, 2009, Mr. Sotelo’s licenses to participate as a groom and exercise rider in thoroughbred racing be, and is hereby, revoked, and it is further ORDERED, that Mr. Sotelo is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under jurisdiction of the Board. |
