| Ruling Text: Apprentice Jockey Neftali Perez, rider of the #8 horse "Clery's Eyes" is suspended for 7 calendar days effective Friday November 5, 2010 through Thursday November 11, 2010 inclusive for interfering with the #9 horse "Straight Action" and the #1 horse "Almost a Fools Day" in the stretch during the running of the 5th race on Thursday October 28, 2010. This suspension is stayed pending the outcome of his appeal filed Tuesday November 2, 2010. PER BOARD FINDING AND ORDER DATED JULY 5, 2011; ORDERED, that the seven day suspension of Respondent, Neftali O. Perez, imposed by the Steward at Finger Lakes Racetrack is affirmed, and during his suspension he is denied the privileges of the grounds of all racetracks under the jurisdiction of this Board. Having received a hearing before the New York State Racing and Wagering Board, and that Board having affirmed the decision of the Stewards concerning the running of the 5th race on October 28, 2010; Jockey Neftali Perez is hereby suspended for 7 calendar days effective Monday October 24, 2011 through Sunday October 30, 2011 inclusive. |
