| Ruling Text: Having received reports from the New York State Racing and Wagering Board's Equine Drug Testing Laboratory of the finding of Theophylline in the body fluid samples taken from the horses "Cool Mountain" the #1 horse which finished 2nd in the 4th race on August 6, 2010; "Brocco Valley" the #5 horse which finished 2nd in the 1st race on August 7, 2010 and "She's an Outlaw" the #4 horse which finished 2nd in the 3rd race on August 17, 2010 and in consideration of his waiving his right to appeal along with his past history, Owner/Trainer Felix O. Monserrate is suspended for 45 calendar days effective Sunday September 19, 2010 through Tuesday November 2, 2010 inclusive and fined the sum of $1,500.00. During the term of his suspension Owner/Trainer Felix O. Monserrate is denied the privileges of the grounds of Finger Lakes Gaming and Racetrack. Owner/Trainer Felix O. Monserrate is warned about taking any part in the training or management in any horses which may be transferred to any other person.
