| Ruling Text: Jockey Paul A. Nicol Jr., rider of the #4 horse "Stellaluce", is hereby suspended for 10 calendar days effective Friday August 27, 2010 through Sunday September 5, 2010 inclusive for interfering with the #2 horse "Sweet Hot Toddy" at the head of the stretch during the running of the 7th race on Tuesday August 17, 2010. This suspension is stayed pending the outcome of Jockey Paul A. Nicol's appeal filed on Monday August 23, 2010. PER BOARD FINDING AND ORDER DATED JULY 5, 2011: ORDERED, that the ten day suspension of Respondent, Paul A. Nicol, Jr., imposed by the Steward at Finger Lakes Racetrack is affirmed, and during his suspension he is denied the privileges of the grounds of all racetracks under the jurisdiction of this Board. Having received a hearing before the New York State Racing and Wagering Board and that Board having affirmed the Stewards decision concerning the running of the 7th race at Finger Lakes Race Track on August 17, 2010, Jockey Paul A. Nicol Jr. is suspended for 10 calendar days effective Friday July 15, 2011 through Sunday July 24, 2011 inclusive. Jockey Paul Nicol Jr. is granted an administrative stay pending his application for an article 78 regarding his 10 day suspension dated July 11, 2011. STIPULATION, August 17, 2012, William A. Sekellick: Pursuant to the terms of the settlement of the above, your 10 day suspension will start on Friday, August 24, 2012 though Sunday, September 2, 2012. Your access to the race track will not be restricted. |
