Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board, at its office located at One Broadway Center, Sixth Floor, Schenectady, New York, on August 5, 2010 at 11:00 a.m., why, pursuant to Section 309, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law (RPWBL), your license to participate in pari-mutuel harness racing as a Trainer should not be suspended for a period of 180 days and a fined in the amount of $1,000, any additional penalty imposed as the Board deems appropriate. FINDINGS AND ORDER, September 1, 2011, Kristen M. Buckley: ORDERED, that Respondent’s license as a trainer is hereby revoked and a fine of $1,000 is imposed; and it is further ORDERED, that the fine must be paid by September 15, 2011, and if not paid by October 1, 2011, Respondent will be assessed interest or a late payment charge and may be subject to further Board action; and it is further ORDERED, that during the period of his revocation, Respondent shall not directly or indirectly participate in New York pari-mutuel horse racing, he is denied the privileges and use of the grounds of all racetracks, and he is forbidden to participate in any share of purses or other payment. Every horse, moreover, is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State that is (a) owned or trained by him, or any individual who serves as his agent or employee, during his revocation; or (b) for which he, during his revocation and/or while unlicensed is involved, directly or indirectly, with its training including but not limited to arrangements made to care for, train, enter, race, invoice, collect fees or payments, manage funds, employ or insure workers, provide advice or information, or otherwise assist with any aspect of the training of the horse.
