| Ruling Text: PLEASE TAKE NOTICE that your occupational license to participate in pari-mutuel harness racing as a GROOM is hereby SUSPENDED IMMEDIATELY pending the disposition by the Board of the scheduled hearing before the New York State Racing and Wagering Board or, if you refuse such hearing or default in appearing, SUSPENDED until such time as the Board in its discretion takes further action, including but not limited to license suspension or revocation or refusal to license. FINDINGS AND ORDER, OCTOBER 22, 2010, Gail Pronti: ORDERED, that the Board’s summary suspension of Mr. Pennington’s license to participate as a groom in harness racing be, and is hereby, upheld, and that such license be, and is hereby, revoked, and that Mr. Pennington be prohibited from obtaining a license until three months following proof of successful completion of a drug rehabilitation program, and that such license include conditions similar to those contained in a June 5, 2010 Consent to Conditions for Re-Instatement signed by Mr. Pennington, and it is further ORDERED, that Mr. Pennington is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under jurisdiction of the Board. |
