| Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board at its main office at 1 Broadway Center, Suite 600, Schenectady, New York, 12305, 10:00 A.M., Tuesday, July 13, 2010, why your license to participate as a groom in pari-mutual thoroughbred racing should not be suspended or revoked pursuant to Section §220 of the Racing, Pari-Mutuel Wagering and Breeding Law and the Rules and Regulations of the New York State Racing and Wagering Board, 9E NYCRR §§4002.8,4002.9(a), and 4002.10, because: 1. On October 13, 2009 you were arrested by the Troy Police Department for violation of Section 130.52, 130.55, and 135.05 of the Penal Law of the State of New York. 2. On January 21, 2010 you were requested to appear before the Board on February 10, 2010 regarding the status of the charges, and you failed to appear on that date. 3. Your experience, character and general fitness are such that participation in racing by you would be inconsistent with the public interest, convenience or necessity, or in the best interest of racing generally. FINDINGS AND ORDER, SEPTEMBER 22, 2010, Gail Pronti; ORDERED, that the license of Respondent, Salbador Ceballos is suspended pending disposition of the criminal matter until he provides proof that the criminal charges have been disposed of in his favor, and is deemed revoked if he is convicted of any of the criminal charges, and he is denied the privileges of the grounds of all racetracks under the jurisdiction of this Board. |
