| Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board (the Board), at its office located at Finger Lakes Race Track, 5857 Route 96, Farmington, New York, on June 17, 2010 at 10:00 a.m., why, pursuant to Racing, Pari-Mutuel Wagering and Breeding Law section 213(2) your license to participate in pari-mutuel thoroughbred racing as a Groom should not be revoked and/or further suspended in addition to the current 60-day suspension that expires on June 29, 2010, because: 1. You were in possession of an illegal electric device on or about May 14, 2010 at Finger Lakes Race Track in violation of 9(E) NYCRR 4042.1 subdivision (e); 2. You were in possession of a hypodermic needle on or about May 12, 2010 at Finger Lakes Race Track and you are not a board veterinarian, track veterinarian or practicing veterinarian licensed by the Board, in violation of 9(E) NYCRR 4012.1 subdivision (a) paragraph (1); and 3. You were in possession of a bag of marijuana at Finger Lakes Race Track on or about May 14, 2010, in violation of 9(E) NYCRR Section 4012, subdivision (a), paragraph (2). FINDINGS AND ORDER, JULY 22, 2010, GAIL PRONTI; ORDERED, that the 60-day suspension dated May 27, 2010 by Order of Stewart Rainey, New York State Steward for Finger Lakes Race track, is hereby affirmed; and it is further ORDERED, that Mr. HIDALGO’s license to participate in pari-mutuel thoroughbred racing as a GROOM be, and hereby is, revoked. |
