Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board, at its office located at One Broadway Center, Sixth Floor, Schenectady, New York, on June 22, 2010 at 1:30 p.m., why, pursuant to Section 220, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law (RPWBL), your license to participate in pari-mutuel thoroughbred racing as an Owner should not be revoked, and any license application currently before the Board be should not denied. FINDINGS AND ORDER, MAY 14, 2012, Kristen M. Buckley: ORDERED, that any right Mr. Festa may have to a license arising from the valid receipt that was previously issued to Mr. Festa or any continuing rights Mr. Festa may have to a license be and is hereby revoked; and it is further; ORDERED, that Mr. Festa be prohibited from obtaining any new license without proof that the criminal charges that were the basis for the present Order to Show Cause have been dismissed; and it is further ORDERED, that during such time that he is unlicensed, Mr. Festa shall not directly or indirectly participate in New York State pari-mutuel horse racing, he is denied the privileges and use of the grounds of all racetracks, and he is forbidden to participate in any share of purses or related payment. While he is unlicensed, every horse that he owns or may own in the future is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, nor shall any horse that is owned by him or by any individual who serves as his agent or employee be allowed to participate, which shall include any horse for which he is involved, directly or indirectly, with racing, including any arrangement made to enter, race, invoice, collect fees or payments, manage funds, employ or insure workers, provide advice or information, or otherwise assist with any part of its racing.
