Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at One Broadway Center, Schenectady, New York , why your license to participate as a groom in pari-mutuel thoroughbred racing should not be suspended or revoked pursuant to §220 subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law and the Rules and Regulations of the New York State Racing and Wagering Board, 9E NYCRR §§4002.8 and 4002.9(a) because: 1.You have waived indictment, consented to be prosecuted for, and have pled guilty to the following criminal act: a. Criminal Sex Act in the 3rd degree: (New York Penal Law § 130.40 subdivision 1, a Class E Felony). 2.Your experience, character and general fitness are such that participation in racing by you would be inconsistent with the public interest, convenience or necessity, or in the best interest of racing generally. FINDINGS AND ORRDER, JULY27, 2010, Gail Pront: ORDERED, that the license of Respondent, CARL S. WILEY is revoked, and he is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under the jurisdiction of this Board.
