Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board, why, pursuant to Racing, Pari-Mutuel Wagering and Breeding Law section 213(2) and 9 NYCRR sections 4002.1(j) and 4002.19 your license to participate in pari-mutuel thoroughbred racing as an Assistant Trainer/Exercise Rider should not be suspended and/or revoked. STIPULATION, Mark Stuart, February 14, 2012: It is hereby STIPULATED that this matter shall be withdrawn without prejudice upon the conditions that Kristina Dupps continue to comply with her agreement with the DOL to the satisfaction of the DOL, and in the event that she applies for a new license with the Racing and Wagering Board, that she continue to comply with the agreement to the satisfaction of the DOL or furnish a copy of the full release or satisfaction; and it is further STIPULATED that the Racing and Wagering Board dismisses the charge that Kristina Dupps has an outstanding judgment in the amount of $808 due and owing to Abraham & Strauss in that Abraham & Strauss is no longer in business and no further information is available regarding the assumption of credit by any successor to Abraham & Strauss, and satisfaction of the obligation is impossible. And it is further, STIPULATED that, based upon the recent passing of her husband and in the best interests of justice, the Racing and Wagering Board hereby dismisses the remaining charges that Kristina Dupps failed to respond to correspond or otherwise communicate with the Board or meet with the Board regarding financial records and information. And it is further STIPULATED that the Racing and Wagering Board reserves the right consider the facts of this matter in relation to the evaluation of future license applications with the Board, or to suspend or revoke Kristina Dupps’ license for violation of the Racing, Pari-Mutuel Wagering and Breeding Law or the Board’s rules and regulations, including her failure to comply with this stipulation, accumulation of other unpaid obligations or otherwise demonstrates financial irresponsibility.
