| Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU A LICENSE TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 3/26/2010, RECEIPT# YR 1302649, FOR THE FOLLOWING REASON: YOUR EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT YOUR PARTICIPATION IN RACING OR RELATED ACTIVITIES WOULD BE INCONSISTENT WITH THE PUBLIC INTEREST,CONVENIENCE OR NECESSITY, OR WITH THE BEST INTERESTS OF RACING GENERALLY. FINDINGS AND ORDER, 9/28/2010, Gail Pronti; ORDERED, that the Board’s April 30, 2010 denial for a license as a groom in harness racing be, and is hereby affirmed; and that Mr. Hongach is denied the privileges of the grounds, whether as a patron or otherwise, of all racetracks under the jurisdiction of this Board; and IT IS FURTHER ORDERED and that Mr. Hongach be permitted to re-apply for a groom’s license in harness racing three (3) months from the date of this order; and that the application shall be considered approvable provided there is no further derogatory information that has not previously been disclosed to the Board. |
