| Ruling Text: YOU ARE HEREBY ORDERED TO SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at One Broadway Center, Schenectady, New York on Wednesday, April 14, 2010 at 10:00 A.M., why your license to participate as an owner in pari-mutuel thoroughbred racing should not be suspended or revoked pursuant to Section 220, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law and the Rules and Regulations of the New York State Racing and Wagering Board, 9E NYCRR §§4002.8 and 4002.9(a) because: 1. On February 25, 2009, you were indicted by a Grand Jury of the County of Nassau for the following crimes: a. Criminal sale of a controlled substance in the second degree, (New York Penal Law §220.41 subdivision 1, a Class A-II felony); b. Five counts of Criminal sale of a controlled substance in the third degree, (New York Penal Law §220.39 subdivision 1, a Class B felony). c. Eight counts of Criminal possession of a controlled substance in the third degree, (New York Penal Law § 220.16, subdivision 1 a Class B felony); d. Six counts of Criminal possession of a controlled substance in the seventh degree, (New York Penal Law § 220.03 a Class A misdemeanor); and e. Criminal possession of a controlled substance in the fourth degree, (New York Penal Law § 220.09 subdivision 1, a Class C felony); 2. Your experience, character and general fitness are such that participation in racing by you would be inconsistent with the public interest convenience or necessity, or in the best interest of racing generally. |
