| Ruling Text: Having waived your right of appeal, your license to participate in harness racing is suspended for the period of one year from March 14, 2010 through and including March 13, 2011 and you are fined the sum of two thousand five hundred dollars ($2500) because the horses, “Radiant Hall” who finished 1st and “West Gun” who finished 3rd, trained by you, competed with excess pre-race TCO2 levels at Yonkers Raceway on January 14, 2010 and January 16, 2010 respectively, in violation of 9 NYCRR §§ 4120.13 and 4120.4. You are required to return the purse money from both races to Yonkers Raceway. During the period of his suspension, you shall not directly or indirectly participate in New York pari-mutuel horse racing and are denied the privileges and use of the grounds of all racetracks. You are forbidden to participate in any share of purses or other payment. Every horse is denied the privileges of the grounds and shall not participate in pari-mutuel racing in New York State, further, that is (a) owned or trained by you or any individual who serves as your agent or employee, during this suspension; or (b) for which you, during this suspension, are involved, directly or indirectly, with its training including arrangements made to care for, train, enter, race, invoice, collect fees or payments, manage funds, employ or insure workers, provide advice or information, or otherwise assist with any aspect of the horse’s training. |
