Ruling Text: AFTER CAREFUL CONSIDERATION, YOU ARE HEREBY NOTIFIED THAT THE BOARD REFUSES TO ISSUE YOU A LICENSE TO PARTICIPATE IN RACING IN THE STATE OF NEW YORK, FOR WHICH YOU APPLIED ON 06/03/2010, RECEIPT# MO 1297754, FOR THE FOLLOWING REASON: YOUR EXPERIENCE, CHARACTER AND GENERAL FITNESS ARE SUCH THAT YOUR PARTICIPATION IN RACING OR RELATED ACTIVITIES WOULD BE INCONSISTENT WITH THE PUBLIC INTEREST,CONVENIENCE OR NECESSITY, OR WITH THE BEST INTERESTS OF RACING GENERALLY. FINDINGS AND ORDER, JUNE 23,2010, GAIL PRONTI: GRAHAM LEWIS, having appealed from Notice No. MO12-2010, dated January 15, 2010, by which The New York State Racing and Wagering Board, Licensing Division, refused to issue him a license to participate in Harness Racing as a trainer/driver in the State of New York pursuant to Racing, Pari-Mutuel Wagering and Breeding Law § 309(2) (e) (ii) because his experience, character and general fitness are such that his participation in harness racing would not be in the best interest of racing or the public interest, convenience or necessity, or in the best interest of racing generally; and The Respondent, Graham Lewis, having received proper notice, been represented by counsel and participated in the hearing of his appeal conducted on April 20, 2010; and the Hearing Officer having rendered his report on June 21, 2010, which is attached hereto and incorporated herein; THE BOARD, after due deliberation, having adopted the Hearing Officer’s findings and conclusions at its regular meeting on June 23, 2010, THEREFORE, upon the record, the Report of the Hearing Officer, and the findings of fact and conclusions of law adopted herein, it is hereby ORDERED, that the refusal to issue a license to Respondent to participate in Harness Racing as a trainer/driver is affirmed and he is denied the privileges of the grounds of all pari-mutuel harness tracks in the State of New York, whether as a patron or otherwise.
