| Ruling Text: Having received a report from the New York State Racing and Wagering Board' s equine drug testing laboratory at Cornell University of the finding of Clenbuterol and Flunixin in the body fluid samples taken from the #4 horse "Old Hussy" who finished 3rd in the 6th race on September 21, 2009, Owner/Trainer Ortis Henry is herby suspended for 22 days effective Sunday November 15, 2009 through Sunday December 6, 2009 inclusive and fined the sum of $500.00. A subsequent post race positive received in the 5th race on October 8, 2009 in which "Old Hussy" finished 2nd is considered in this penalty due to the fact that the second positive occurred before the Board was notified of the first positive. During the period of his suspension, Owner/Trainer Ortis Henry is denied the privileges of the grounds of Finger Lakes Gaming and Race Track. Furthermore; the Stewards order "Old Hussy" to be disqualified from any part of the purses and the purses to be redistributed as follows: 6th race on 9/21/09 1st #5 Sarahsthejudge 2nd #7 Society Bubbles 3rd #1 Ultimate Star 4th #6 Wheelit 5th #2 Scene N Heard 5th race on 10/8/09 1st #5 Shifty's Angela 2nd #8 Tally Me Out 3rd #4 Northern Pleasure 4th #3 Super Diva 5th #1 Point Me to It 6th #7 My Little Fortune 7th #2 Scene N Heard |
