| Ruling Text: While driving (Nora's Dream T) in the 9th Race you interfered with #2 (Doom Machine) and #3 (Devilinhiseyes) impeding their progress in the first turn. FINDINGS AND ORDER, December 15, 2009, Gail Pronti: ORDERED, that the Decision of the Presiding Judge at Batavia Downs to impose an eight (8) day suspension of the driver license of Keith Ball for, in the 9th race at Batavia Downs on August 10, 2009, bearing in and interfering with and impeding the progress of the horses “Devilinhiseyes” and “Doom Machine,” in violation of 9 NYCRR § 4117.4(a, c, k), is DISMISSED. |
