| Ruling Text: The horse, #4 "BLAZING SHADOWS T" trained by you, finished 1st in the 12th race on 11/04/2008 while the drug Flunixin was present in its system. The horse is disqualified from the 1st Place finish, and all purse money earned by the horse on that particular day is to be returned. Having appeared before a representative of New York State Racing & Wagering Board, and having filed an appeal, and having paid your fine, your suspension of 20 days is hereby stayed pending final determination of the Board. FINDINGS AND ORDER, 07/23/2009, Gail Pronti: ORDERED, that the $500.00 fine, direction to return the purse and 20 day suspension imposed on Respondent Anthony T. Giovannelli, Jr., by the Judges at Monticello Raceway is affirmed; and it is FURTHER ORDERED that for his fraudulent attempt to obstruct the Board’s investigation of the post-race positive blood and urine sample, and violation of the conditions of his license, Respondent, Anthony T. Giovannelli, Jr., is fined in the amount of $2,500.00 and his licenses and/or valid receipts to participate in pari-mutuel harness racing be and hereby are revoked for an indefinite period until such time as he can demonstrate that his experience, character and general fitness are such that his participation in pari-mutuel harness racing is consistent with the public interest, convenience or necessity, or in the best interest of racing. |
