| Ruling Text: You are hereby suspended 30 days reduced to 15 days for having waived your right of appeal December 26, 2006 through January 9, 2009 inclusive and you are fined $1000.00 for the finding of the drug Clenbuterol in the post race samples of horse Russian Sage who finished 2nd in the first race at Belmont Racetrack on October 17, 2008. This drug was administered in violation of New York State Racing and Wagering Board rules 4043.2 and 4043.4. said horse is hereby disqualified and unplaced in the order of finish. You shall be denied the privileges and use of the grounds of each and every New York State racetrack and no horse owned or trained by you and or your agents or employees shall be allowed to participate in racing in New York. During your period of suspension you shall not participate in New York State pari-mutuel horse racing, directly or indirectly, you shall be denied the privileges and use of the grounds of New York State racetracks and you shall be forbidden to participate in any share of the purses. Horses owned or trained by, or those employees or agents who continue to serve as your agents or employees during such period of suspensions; and horses in regard to which you are making arrangements with owners, directly or indirectly, to care for, train, enter in races, invoice, collect fees or other payments, employee workers. or otherwise handle, shall not be allowed to participate in pari-mutuel racing and are denied the privileges of the grounds. This shall not preclude agents or employees of you, who are not serving as such during the period of your suspension, from participating in pari-mutuel racing as owners, trainer, and grooms as long as they are licensed and perform those duties consistent with the rules and regulations of the State of New York.
