| Ruling Text: For having withdrawn your appeal you are hereby suspended 30 days March 11, 2009 through April 9, 2009 inclusive for the finding of the drug Phenylbutazone in the post race samples of horse Kitty Nip who finished 1st in the 2nd race at Belmont Racetrack on September 13, 2008. This drug was administered in violation of New York State Racing and Wagering Board rules 4043.2 and 4043.5. Said horse is hereby disqualified and unplaced in the order of finish. You shall be denied the privileges and use of the grounds of each and every New York State racetrack and no horse owned or trained by you and or your agents or employees shall be allowed to participate in racing in New York. During your period of suspension you shall not participate in New York State pari-mutuel horse racing , directly or indirectly, you shall be denied the privileges and use of the grounds of New York State racetracks and you shall be forbidden to participate in any share of the purses. Horses owned or trained by , or those employees or agents who continue to serve as your agents or employees during such period of suspension; and horses in regard to which you are making arrangements with owner, directly or indirectly, to care for, train, enter in races, invoice, collect fees or other payments, employee workers, or otherwise handle, shall not be allowed to participate in pari-mutuel racing and are denied the privileges of the grounds. This shall not preclude agents or employees of you, who are not serving as such during the period of your suspension, from participating in pari-mutuel racing as owners, trainer, and grooms as long as they are licensed and perform those duties consistent with the rules and regulation of the State of New York.
