| Ruling Text: YOU ARE HEREBY ORDERED to SHOW CAUSE, before the New York State Racing and Wagering Board at its main office located at 1 Broadway Center, Suite 600, Schenectady, New York, 12305 at 10:30 A.M., Thursday, October 30, 2008, pursuant to Section 309, subdivision 2 of the Racing, Pari-Mutuel Wagering and Breeding Law ("Racing Law"), and the Rules and Regulations of the New York State Racing and Wagering Board, 9 NYCRR Parts 4102.1 and 4119.11: Why your license to participate in pari-mutuel harness racing as a groom should not be denied, suspended or revoked, and/or a fine imposed pursuant to 9 NYCRR §4102.3(a)(1)-(4) for violation of the conditions of a voluntary agreement that you signed July 29, 2008, a copy of which is attached. The agreement required you to participate in the NYSRWB’s Drug/Alcohol Abuse Program. You were evaluated by a New York State certified alcohol and drug treatment program which determined that you needed treatment, but you failed to satisfactorily complete the program, in violation of 9 NYCRR §4119.11 FINDINGS AND ORDER, FEBRUARY 26, 2009, Gail Pronti: ORDERED, that the license of Respondent is revoked for violation of his voluntary agreement and violation of 9 NYCRR § 4102.3 (a) (1)-(4) and §4119.11, and his experience, character and general fitness are such that participation in racing by him would be inconsistent with the public interest convenience or necessity, or in the best interest of racing generally. |
