| Ruling Text: Having received a report from the New York State Racing and Wagering Board' s Equine Drug Testing Laboratory at Cornell University of the finding of Lidocaine and it's metabolites in the body fluid samples of the horse "Barco" which finished 1st in the 3rd race on May 9, 2008 at Finger Lakes Race Track and having waived his right to appeal, Owner/Trainer David J. Markgraf is suspended for 15 calendar days effective Monday September 22, 2008 through Monday October 6, 2008 inclusive and is fined the sum of $250.00. During the period of his suspension, Owner/Trainer David J. Markgraf is denied the privileges of the grounds of Race Tracks in New York State. In a previous ruling dated July 3, 2008 the Stewards ordered "Barco" disqualified from any part of the purse from the 3rd race on May 9, 2008. |
