| Ruling Text: This was for the drug fluphenazine, the penalty for which is included under, 4120.11 Reserpine and Fluphenazine. a.) Notwithstanding any inconsistent provision of this part, a finding by the laboratory the drug reserpine or the drug fluphenazine was present in the sample taken from a horse shall result in the disqualification of the horse from the race and from any share of the purse of the race. b.) The trainer of a horse which has been the subject of a finding by the laboratory that the drug reserpine or the drug fluphenazine was present in the sample taken from that horse shall not be subject to application of trainer's responsibility based solely upon the finding of the laboratory that the drug reserpine or the drug fluphenazine was present in the sample. The horse Samcamawakybrown raced at Tioga Downs on June 27th, 2008 has been disqualified and the purse redistributed. |
