| Ruling Text: As trainer of record on 8/19/2008 in the 11th race #3(Outback Papeete) you failed to receive lasix by the prescribed time necessitating a scratch. FINDING AND ORDER, FEBRUARY 26, 2009, Gail Pronti: THE BOARD, after due deliberation, hereby adopts the Hearing Officer’s findings of fact and conclusions of law, except the $300.00 fine is reduced to $250.00 to achieve relative consistency with similar violations THEREFORE, upon the record, the Report of the Hearing Officer, and the findings and conclusions adopted herein, it is hereby ORDERED, that the $300.00 fine imposed on Respondent Mark S. Ford by the Judges at Yonkers Raceway is reduced to $250.00 and in all other respects the decision is affirmed. |
